American Transit Insurance Company has withdrawn a federal lawsuit against Dr. Emmanuel “Manny” Hostin, the husband of The View cohost Sunny Hostinafter accusing the New York City orthopedic surgeon of fraud.
A complaint filed in January naming nearly 200 defendants alleged that Dr. Hostin “knowingly provided fraudulent medical and other healthcare services including arthroscopic surgeries to Covered Persons through Hostin Orthopaedics” and fraudulently billed American Transit “in exchange for kickbacks and/or other compensation which were disguised as dividends or other cash distributions.”
On Thursday, ATIC issued a statement saying it “has voluntarily withdrawn the suit against Dr. Hostin, and dismissed the lawsuit with prejudice.” The company has also “agreed to make payment on the invoices submitted by Dr. Hostin to ATIC.”

American Transit said it named Dr. Hostin in the civil RICO case “because he holds a small share of a surgical center that was involved in the dispute,” but “after further discussions with Dr. Hostin and his attorneys and investigation by ATIC,” the company was moved to withdraw the suit.
The statement concluded: “Furthermore, ATIC deeply regrets any public speculation against Dr. Emmanuel Hostin, his wife, Sunny Hostin, or his children, which may have resulted from the lawsuit.”
When reached for comment, the Hostins’ legal representative, Mark Geragos, provided Entertainment Weekly with a statement.
“American Transit, reportedly in financial straits and apparently in an attempt to avoid paying medical bills, named Dr. Emmanuel Hostin, a respected surgeon, in a lawsuit,” Geragos wrote. “In what can be described as a blatant attempt to weaponize Sunny Hostin’s celebrity, they tried to leverage a settlement. Dr. Hostin and Sunny refused to fold. They fought back, and today American Transit dismissed the case with prejudice, agreed to pay what was owed Dr. Hostin, and publicly apologized. Dr. Hostin, Sunny Hostin, and their family have been fully vindicated.”

American Transit centers its work on Uber, Lyft, and taxi drivers, and said in its initial complaint that this type of fraud is “rampant” and “endemic to the New York State” — where Dr. Hostin practices at his Manhattan medical office — due to its No-Fault (or Personal Injury Protection) law.
Daniel Thwaites, an attorney for Dr. Hostin, said in January that his client “denies each and every allegation” and called the suit a “blanket, scattershot, meritless lawsuit by a near-bankrupt insurance carrier.”
Dr. Hostin married The View‘s legal expert in 1998, two years after they met at a bagel shop following a church service they both attended in Maryland. They share two children, Paloma and Gabriel.

The View star regularly speaks about her family, including Manny, on the air, and the doctor even appeared on his wife’s 2023 birthday episode.
